P-9.001, r. 3 - Regulation respecting toll road infrastructures operated under a public-private partnership agreement

35. A person designated by the Minister of Transport as a person entrusted with the enforcement of the Act respecting transport infrastructure partnerships (chapter P-9.001) for the purposes of drawing up the offence report referred to in article 62 of the Code of Penal Procedure (chapter C-25.1) must, at the time he or she is designated,
(1)  be of full age;
(2)  not have, in the last 5 years, been found guilty of or pleaded guilty to a criminal offence related to the activities he or she will have the authority to perform under that designation, unless he or she has obtained a pardon;
(3)  have taken the oath in Schedule 1 before a person authorized to administer oaths.

35. An employee of the partner designated by the Minister of Transport as a person entrusted with the enforcement of the Act respecting transport infrastructure partnerships (chapter P-9.001) for the purposes of drawing up the offence report referred to in article 62 of the Code of Penal Procedure (chapter C-25.1) must, at the time he or she is designated,
(1)  be of full age;
(2)  not have been found guilty of or have pleaded guilty to a criminal offence within the past 5 years involving the activities he or she may be called on to perform as a result of having been so designated, unless he or she has obtained a pardon;
(3)  have taken the oath in Schedule 1 before a person authorized to administer oaths.
